These Terms of Service (“Terms”) govern your use of olumllc.com and the services provided by Olum LLC (“Olum,” “we,” “us,” or “our”). By accessing our website or engaging our services, you agree to these Terms. If you do not agree, do not use our website or services.

These Terms form a binding agreement between you and Olum LLC, a limited liability company registered in the State of New Mexico, United States.

Olum provides website design, hosting, marketing automation, search engine optimization, content creation, and related digital services to businesses. The specific services available to you depend on the plan you select and any additional services you engage. We may add, modify, or discontinue features at our discretion, with reasonable notice for material changes.

Some services require you to provide accurate, current, and complete information when engaging us. You are responsible for maintaining the confidentiality of any login credentials we provide and for all activity under your account. Notify us immediately at Hammad@olumllc.com if you suspect unauthorized access.

You must be at least 18 years old and authorized to bind your business to these Terms in order to engage our services.

Our services are offered on monthly and annual subscription plans. Fees are billed in advance and are non-refundable except as expressly provided in these Terms or as required by law. Setup fees, where applicable, are due before work begins.

We may change pricing for new subscription periods with at least 30 days notice. Pricing for your current subscription period will not change. Continued use of the services after a price change takes effect constitutes acceptance of the new pricing.

Late payments may result in service suspension. We may charge a reasonable late fee in accordance with applicable law.

You may cancel your subscription at any time with 30 days written notice to Hammad@olumllc.com. Cancellation takes effect at the end of your current billing period. You remain responsible for any unpaid fees through the cancellation date.

We offer a 30-day money-back guarantee on initial subscriptions. If you cancel within 30 days of your initial subscription start date, we will refund all subscription fees paid. The money-back guarantee does not apply to renewal periods or one-time fees such as setup.

Upon cancellation, we will export your website files and content to you within 14 days. You will retain ownership of your domain, your content, and the final website files.

The website templates, underlying software, design systems, and documentation we develop remain our intellectual property. Upon full payment, and unless otherwise agreed in writing, you receive a perpetual, non-exclusive, worldwide license to use the final website we deliver for your business.

The Olum name, logo, and brand elements are our property. You may not use them without our prior written permission.

You retain ownership of all content, photos, copy, and materials you provide to us (“Client Content”). You grant us a non-exclusive, worldwide, royalty-free license to use Client Content as necessary to deliver our services and, with your consent, to feature your work in our portfolio.

You represent and warrant that you have all rights necessary to provide Client Content to us, and that Client Content does not infringe the intellectual property, privacy, publicity, or other rights of any third party.

You agree not to use our services to:

• Violate any applicable law or regulation
• Infringe the intellectual property or other rights of others
• Distribute malware, spam, or harmful content
• Engage in fraudulent or deceptive business practices
• Harass, threaten, or harm others
• Misrepresent your identity or affiliation
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the integrity of the services

We may suspend or terminate services for any violation of this section, with or without notice.

We strive for high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or modifications that temporarily affect availability. We will provide reasonable notice for planned maintenance where practicable.

Our services are provided “as is” and “as available.” We make no warranties, express or implied, regarding the services, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the services will be uninterrupted, error-free, or meet your specific requirements.

We do not guarantee specific business outcomes, search rankings, lead volumes, or revenue results. Marketing and SEO outcomes depend on many factors outside our control, including competition, market conditions, and search-engine algorithm changes.

To the maximum extent permitted by law, Olum LLC and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, arising out of or related to your use of our services.

Our total liability for any claim related to the services will not exceed the amount you paid us in the 12 months preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the greatest extent permitted by law.

You agree to indemnify and hold harmless Olum LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the services, your violation of these Terms, or your violation of any rights of a third party.

These Terms are governed by the laws of the State of New Mexico, United States, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or our services will be resolved exclusively in the state or federal courts located in New Mexico, and you consent to the personal jurisdiction of those courts.

You waive any right to participate in a class action against us. Disputes must be brought individually.

We may update these Terms from time to time. Material changes will be communicated by email or website notice with at least 30 days notice before they take effect. Continued use of the services after changes take effect constitutes acceptance of the updated Terms.
